From March 2024, Google made available to<br \/>\n  qualifying recipients the relevant search dataset including appropriately anonymized data in order<br \/>\n  to comply with Art. 6(11) DMA. On July 16, 2026, the European Commission adopted<br \/>\n  <a href=\"https:\/\/ec.europa.eu\/competition\/digital_markets_act\/cases\/202629\/DMA_100209_2712.pdf\" class=\"external-link\">measures<\/a><br \/>\n  further specifying how Google should comply with its obligations under Art. 6(11) DMA (the<br \/>\n  <b>Measures<\/b>), by making available to qualifying recipients a specified search dataset (the<br \/>\n  <b>Search Dataset<\/b>).<\/p>\n<ul>\n<li><b>The European Commission&#8217;s Measures and associated criteria and requirements for accessing<br \/>\n    the Search Dataset:<\/b> The Measures cover recipient eligibility, the scope of the data that<br \/>\n    should be made available, the frequency with which Google should make the data available, the<br \/>\n    fair, reasonable and non-discriminatory (<b>FRAND<\/b>) terms for access to such data, and the<br \/>\n    specific purposes for which the data can be used. Since recipients will receive personal data<br \/>\n    under the Measures, they also establish the associated liability for the receipt of such data<br \/>\n    and specify detailed technical and organizational requirements regarding data segregation,<br \/>\n    access control, and logging, all of which are subject to third-party auditing and reporting.<br \/>\n    Access to the data is also subject to recipients accepting Google&#8217;s licensing terms. For more<br \/>\n    details, see the<br \/>\n    <a href=\"https:\/\/ec.europa.eu\/competition\/digital_markets_act\/cases\/202629\/DMA_100209_2712.pdf\" class=\"external-link\">Measures<\/a>.<\/li>\n<li><b>The Search Dataset:<\/b> Comprises ranking, query, click, and view data from Google Search in<br \/>\n    the European Economic Area (<b>EEA<\/b>). More details can be found in the<br \/>\n    <a href=\"https:\/\/ec.europa.eu\/competition\/digital_markets_act\/cases\/202629\/DMA_100209_2712.pdf\" class=\"external-link\">Measures<\/a><br \/>\n    and technical details will be provided to relevant applicants in due course in accordance with<br \/>\n    the Measures.<\/li>\n<li><b>FRAND pricing basis and process:<\/b> Fees are determined on FRAND terms, which the Measures<br \/>\n    limit to the incremental costs of making the data available, together with a specified rate of<br \/>\n    return. Further details are set out in the<br \/>\n    <a href=\"https:\/\/ec.europa.eu\/competition\/digital_markets_act\/cases\/202629\/DMA_100209_2712.pdf\" class=\"external-link\">Measures<\/a><br \/>\n    and will be provided to relevant applicants in due course in accordance with the Measures.<\/li>\n<\/ul>\n<h2 id=\"eligibility\" tabindex=\"-1\">Eligibility criteria to receive search data<\/h2>\n<p>To qualify in principle for a license, interested applicants must meet the following conditions<br \/>\n  specified in the Measures:<\/p>\n<ul>\n<li><b>Online search engine (OSE):<\/b> The applicant must qualify as a provider of an online<br \/>\n    search engine as defined in Art. 2(6) DMA.<\/li>\n<li><b>Operating in the<br \/>\n    <a href=\"https:\/\/ec.europa.eu\/eurostat\/statistics-explained\/index.php?title=Glossary:European_Economic_Area_(EEA)\" class=\"external-link\">EEA<\/a>:<\/b><br \/>\n    The applicant must operate within the EEA, meaning that their online search engine must be<br \/>\n    directed at users located in the EEA.<\/li>\n<li><b>Control by non-EEA states:<\/b> The applicant must not be directly or indirectly subject<br \/>\n    to the control of a non-EEA state that poses a serious and structural cyber security and\/or<br \/>\n    data protection risk.<\/li>\n<li><b>No connection to an entity subject to restrictive measures or sanctions:<\/b> The applicant<br \/>\n    must not be directly or indirectly under the operation or control of any natural or legal person<br \/>\n    subject to restrictive measures or sanctions under European Union (<b>EU<\/b>) law.<\/li>\n<li><b>Number of users and activity in the EU:<\/b> The applicant must (i) either have provided OSE<br \/>\n    services in the EU for at least the last two consecutive years at the time of applying, or have<br \/>\n    been founded less than two years before applying but received more than EUR 50 million in<br \/>\n    capital investments; and (ii) have had at least 50,000 monthly average users of its OSE services<br \/>\n    in the EU in the past year.<\/li>\n<\/ul>\n<p>Google may ask you to provide supporting documents to verify that you meet the above requirements.<\/p>\n<h2 id=\"access-to-data\" tabindex=\"-1\">Access to data samples before application<\/h2>\n<p>Before purchasing access to the Search Dataset, eligible applicants may request access to data<br \/>\n  samples, as follows:<\/p>\n<ul>\n<li><b>Sample A:<\/b> A 1,000-row dataset provided free of charge.<\/li>\n<li><b>Sample B:<\/b> A synthetic dataset of up to 10 million queries for a fee.<\/li>\n<li><b>Sample C:<\/b> A 5% sample of the Search Dataset for a fee.<\/li>\n<\/ul>\n<p>More details on the data samples can be found at paragraphs 101&ndash;114 of the<br \/>\n  <a href=\"https:\/\/ec.europa.eu\/competition\/digital_markets_act\/cases\/202629\/DMA_100209_2712.pdf\" class=\"external-link\">Measures<\/a><br \/>\n  and will be provided in due course. The data samples will be available as of November 16, 2026.<\/p>\n<h2 id=\"technical-requirements\" tabindex=\"-1\">Technical and organizational requirements and third-party audits<\/h2>\n<p>While the Measures require Google to apply a set of technical measures to the search data<br \/>\n  before sharing, the data that will be provided will still contain personal data and the Measures<br \/>\n  rely on the recipients&#8217; internal data segregation so that individuals won&#8217;t be re-identified. As such, the<br \/>\n  Measures require a significant technical and organizational commitment to data separation, control,<br \/>\n  and auditability. Among other things, this includes:<\/p>\n<ul>\n<li>As a mandatory pre-requisite for access to Sample C and the Search Dataset itself, eligible<br \/>\n    applicants must undergo an independent assessment and provide a Level 1 reasonable assurance<br \/>\n    report. This report must be issued by an independent third-party auditor, qualified to inspect the<br \/>\n    applicant&#8217;s technical infrastructure, storage systems, and workflows to verify compliance with the<br \/>\n    program&#8217;s advanced security and privacy standards. For more details on the specific criteria and<br \/>\n    testing protocols required for the Level 1 reasonable assurance report, see paragraphs 69&ndash;72 and<br \/>\n    82&ndash;86 of the<br \/>\n    <a href=\"https:\/\/ec.europa.eu\/competition\/digital_markets_act\/cases\/202629\/DMA_100209_2712.pdf\" class=\"external-link\">Measures<\/a>.<\/li>\n<li>To maintain ongoing access to the Search Dataset, eligible recipients must submit to regular,<br \/>\n    continuous monitoring by an independent assurance practitioner and provide a Level 2 reasonable<br \/>\n    assurance report. This subsequent report, complying with the requirements set out at paragraphs 73<br \/>\n    and 82&ndash;86 of the<br \/>\n    <a href=\"https:\/\/ec.europa.eu\/competition\/digital_markets_act\/cases\/202629\/DMA_100209_2712.pdf\" class=\"external-link\">Measures<\/a>,<br \/>\n    is required to verify sustained and uninterrupted compliance with these operational safeguards.<\/li>\n<\/ul>\n<p>Further specificity on the precise technical and auditability measures required will be available<br \/>\n  in the data licensing agreement, which Google will provide to relevant applicants starting on<br \/>\n  September 17, 2026. The licensing agreement will also establish the overall contractual<br \/>\n  responsibilities recipients owe to Google and to third parties whose personal data they receive.<\/p>\n<h2 id=\"how-to-express-interest\" tabindex=\"-1\">How to express interest in receiving the Search Dataset<\/h2>\n<p>If your organization meets the program&#8217;s eligibility criteria and is prepared to invest in<br \/>\n  achieving the relevant technical, security, and auditability safeguards,<br \/>\n  fill out this <a href=\"https:\/\/docs.google.com\/forms\/d\/14-YHj9hcQmpisVkQIRu0tirtsHETXUNAFibQSb_IA7k\/viewform\" class=\"external-link\">form<\/a><br \/>\n  to request more information or to begin the application process. Google will respond to your<br \/>\n  request within 7 calendar days of receiving your expression of interest, as set out in paragraph 125<br \/>\n  of the <a href=\"https:\/\/ec.europa.eu\/competition\/digital_markets_act\/cases\/202629\/DMA_100209_2712.pdf\" class=\"external-link\">Measures<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Recipients can express interest in participating in the Google European Search Dataset Licensing Program.
